2025 Carewell Caregiver Awards Terms and Conditions

Eligibility: To be eligible for the 2025 Carewell Caregiver Awards (the “Promotion”), each Caregiver Nominee must be located and with a physical address in the United States and have served as a Primary Caregiver for another person for at least three (3) months in the past year. A Primary Caregiver’s responsibilities include, but are not limited to: overseeing personal care duties, housekeeping, transportation, and responsibility for the general health and comfort of their care recipients. Employees, officers and directors of Carewell Family Inc. (“Carewell”), social media influencers who receive compensation to promote the contest, and fulfillment and marketing agencies (all together, "Promotion Parties"), their respective immediate families (parent and spouse, child, sibling (and their respective spouses), regardless of where they reside) and persons living in the same households as such individuals (whether related or not) are not eligible to participate in the Promotion.
All entries are final upon submission.
How to Enter the Promotion:
The Promotion begins and Caregiver Nominations can be made starting Monday, October 14th, 2024 and the deadline to submit nominations is Friday, November 15th, 2024. Winners will be announced on Friday, February 21st, 2025 (the “Promotion Period”).
Enter the Promotion at https://carewell.typeform.com/to/i2XpTQUo by completely entering the true and correct information, for yourself or the person you are nominating, on the registration form in the required fields, including the upload of any video portions of the required fields (each an “Entry”). Upon registering, you will be required to upload a photo of you or the person you are nominating, that will be displayed should you or the person nominated be selected as a winner. You will also be required to confirm your agreement to these Terms and Conditions and that you are 18 years of age or older on the date of registration. Image submissions cannot exceed 10MB. Acceptable file formats include: PDF, DOC, DOCX, .JPG, .JPEG, .PNG, .GIF. You can nominate yourself or another Caregiver only one time throughout the Promotion Period. There is no limit on the number of individual Caregivers you can nominate.
By submitting an Entry, you hereby grant permission for your Entry (including any video portions) and photo to be posted on the Carewell website and any Carewell marketing or social media channels, in perpetuity. You agree that Promotion Parties are not responsible for any unauthorized use of Entries (including any video portions) or photos by third parties. Promotion Parties do not guarantee the posting of any Entry (including any video portions) or photos. You agree that you will not use the Entry (including any video portions) for any other purpose, including, without limitation, posting the Entry (including any video portions) to any online social networks, without the express written consent of Carewell in each instance.
By submitting an Entry, you represent and warrant that the work submitted is original to you and that neither it nor its contents infringe upon or violate the rights of any third party (including any video portions). If your Entry (including any video portions) includes likenesses of third parties or contains any elements not owned by you (such as, but not limited to, company logos) you confirm that you have all necessary rights to post and must be able to provide legal releases demonstrating such rights for each such use in a form satisfactory to Carewell or your Entry will be disqualified. Entries may not defame or invade the publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person's personal or proprietary rights (including any video portions).
Winning Nominee Selection:
After submitting initial nominations have been received, Carewell will select up to five initial nominees (“Finalists”) to submit a video entry on or before November 29, 2024 via telephone call or email notification. Finalists shall have until December 13, 2024 to submit their video entries.
Video entries by Finalists will be reviewed by Carewell, and winners shall be selected based on a review of each Finalist’s initial nomination and video entry, with qualifications and standards as determined by Carewell in its sole discretion (each, a “Winner” and collectively, the “Winners”).
Finalists and the resulting Winners will be selected based on an evaluation of their unique stories of how they went above and beyond as caregivers to support their care recipient.
Prize: The Winner of the Carewell Caregiver of the Year Award will be awarded a cash prize of $5,000.
The Winner of the Veteran Caregiver Hero Award will be awarded a cash prize of $1,000.
The Winner of the Family Caregiver Hero Award will be awarded a cash prize of $1,000.
The Winner of the Companion Caregiver Hero Award will be awarded a cash prize of $1,000.
The Winner of the Parent Caregiver Hero Award will be awarded a cash prize of $1,000.
Except where prohibited by law, by accepting the prize, each Winner grants Carewell a perpetual, worldwide, royalty-free license to use the Winner’s name, Entry, photograph, voice and/or likeness without further authorization, compensation or remuneration of any kind for advertising, promotion and other publicity purposes in any and all media now or hereafter known throughout the world.
All applicable federal, state, local, and other taxes on the prize are the sole responsibility of the Winner. A 1099 tax form will be issued to the Winner.
Miscellaneous: Carewell is not responsible for lost, incomplete, late, damaged, or misdirected Entries; failures or malfunctions of phones, phone lines or telephone systems or other communications malfunctions; interrupted or unavailable network, Internet Service Provider (ISP), server or other connections; miscommunications, failed computer hardware or software or other technical failures; or other errors or problems of any kind whether mechanical, human, technical, electronic or otherwise. By participating, participants agree to be bound by these Terms and Conditions and agree that Carewell and the Promotion Parties (collectively, the “Released Parties”) and their designees may use (unless prohibited by law) their name, voice, city/state of residence, photograph, social handle and/or likeness for advertising and/or trade and/or for any other purpose in any media or format now or hereafter known without further compensation, permission or notification. Carewell reserves the right, in its sole discretion, to modify, suspend or terminate this Promotion (or any portion thereof) should virus, bugs, non-authorized human intervention or other causes beyond the reasonable control of Carewell, including but not limited to war or armed conflict (whether or not officially declared), labor controversy or threat thereof, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of this Promotion and, in the event of termination or suspension, at its discretion, select a Winner from among eligible, non-suspect nominations as of the date of the event requiring such termination or suspension.
Participants irrevocably waive all claims against the Released Parties and agree that the Released Parties will have no liability or responsibility for any claim arising in connection with participation in this Promotion or the prize awarded.
Disputes/Choice of Law: Except where prohibited, each participant agrees that: (i) all issues and questions concerning these Terms and Conditions shall be governed by Delaware law without giving effect to any principles of conflicts of law of any jurisdiction; (ii) any and all disputes, claims and causes of action at law or in equity arising out of or relating to this Promotion or any prize awarded shall be (A) resolved individually, without resort to any form of class action; and (B) filed only in the state or federal courts situated in Delaware, and participant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (iv) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
Privacy: Personally identifiable information that is submitted by participants as part of this Promotion will be used to administer the Promotion and will be treated in accordance with Carewell's privacy policy, accessible at https://www.carewell.com/privacy-policy/.
